2. What are personal data?

According to Art.4 No.1 DSGVO, personal data are all information relating to an identified or identifiable natural person.

3. What data is processed?

3.1 Automatically collected usage data

Each time a user accesses our website, your internet browser automatically transmits certain usage data for technical reasons. This information is stored separately from other data in so-called log files. The following information is recorded:

  • Date and time as well as duration of access,
  • Browser type/ -version,
  • operating system used,
  • URL of the previously visited website,
  • amount of data transferred,
  • based on the IP address (Internet Protocol address), a GeoIP lookup is made,
  • name of the retrieved files,
  • http status code (e.g. “request successful”),
  • and URL of the accessed web page,
  • type of access (GET,POST).

Personal user profiles can therefore not be formed. The above data is only evaluated for statistical purposes.

Personal data is only collected if you provide it voluntarily – for example, in the context of a registration or similar.

Your data will not be passed on to third parties unless we are legally obliged to do so. Insofar as external processors come into contact with your personal data, we have ensured through legal, technical and organizational measures, as well as through regular checks, that they comply with the provisions of data protection laws.

The legal basis for the processing of the data is Art. 6 para.1 lit. f DSGVO and is justified in the smooth functioning of our website.

3.2 Cookies

Cookies are small text files that your Internet browser places and stores on your computer. They are used to optimize our website. These are mostly so-called “session cookies”, which are deleted after the end of your visit. The cookies are technically necessary to make this website available to you.

The legal basis for the processing of the data is Art. 6 para.1 lit. f DSGVO.

4. For what purposes do we process your data and on what legal basis?

4.1 Consent pursuant to Art. 6 Abs. para.1 lit. a DSGVO

If you have given us voluntary consent to process certain personal data, then this consent forms the legal basis for the processing of this data.

If we base data processing on your consent, you have the right to revoke your consent at any time with effect for the future. If possible, please send the revocation by e-mail to ffice.propet@propartner.at. The lawfulness of the processing of your data up to the time of the revocation remains unaffected.

4.2 Data processing based on legitimate interest – Art. para.1 lit. f DSGVO

In certain cases, we process your data to protect a legitimate interest of us or of third parties. A legitimate interest exists, for example, if your data is required for the assertion, exercise or defense of legal claims. In the event of a legal dispute, we have a legitimate interest in processing the data for evidence purposes.

5. To whom is your data passed on?

Within our company, data is only received by those departments and employees who need this data to fulfill contractual or legal obligations and to protect legitimate interests.

In addition, order processors commissioned by us receive your data if they require it to fulfill their respective tasks or to fulfill a contract. Processors commissioned by us are obliged to treat their data confidentially and to process it only within the scope of the service provision in accordance with the legal provisions.

Under certain circumstances, legal representatives and collection agencies commissioned by us as well as public bodies or institutions, for example courts and authorities in the event of legal disputes, may also receive your data.

6. How long will your data be stored?

Personal data of the person concerned will be deleted or made anonymous as soon as the purpose of the storage ceases to apply. In addition, storage may take place if this has been provided for by the European or national legislator in Union regulations, laws or other regulations to which the responsible party is subject. A deletion or anonymization of the data will also take place if a storage period prescribed by the aforementioned standards expires, unless there is a necessity for the continued storage of the data for the conclusion or performance of a contract.

7. Your rights in connection with the processing of your data to?

You can request information about whether we have stored personal data about you. If you wish, we will tell you what the data is, for what purposes the data is processed, to whom this data is disclosed, how long the data is stored and what other rights you have in relation to this data.

You have the right to have your data corrected or to have it deleted or to restrict its processing. You may also request that we provide any personal data you have provided to us in a structured, commonly used and machine-readable format either to you or to a person or company of your choice.

You also have the right not to be subject to a decision based solely on automated processing – including profiling – which produces legal effects concerning you. In the context of the application process, we do not use exclusively automated processing for decision-making.

Furthermore, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6(1) l.it. e DSGVO (data processing in the public interest) or on the basis of Art. 6(1) lit. f DSGVO (data processing for the purposes of safeguarding a legitimate interest); this also applies to profiling based on this provision. In the event of your objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

8. Provision of your personal data

The provision of personal data is not required by law or contract. You are also not obliged to provide the personal data. However, the provision of personal data is necessary for the optimal operation of our website. That is, unless you provide us with personal data, the service of our website may not work.

9. Automated decision making including profiling

No automated decision-making including profiling pursuant to Article 22 DSGVO is carried out by our company.

The website contains links to other websites. When activating these hyperlinks, you will be redirected from one of our websites directly to the website(s) of the other providers. You will recognize this, among other things, by the change of URL.
